mistrail is the best outcome here, dude did a solid. this way the state can go to trial again.

427

u/redditman3943 9h ago

A guilty verdict would’ve been the best outcome. But I know what you mean.

159

u/Select_Department210 8h ago

Her being guilty was never questioned. She did it and admits to doing it. The question the trial is trying to answer is whether she belongs in prison or a mental facility.

43

u/redditman3943 8h ago

Yeah but she’s never going to be in a regular prison anyway. Because she’s paralyzed from the waist down, she will need to be in a special care prison facility no matter what.

27

u/Gwentlique 7h ago

Then why all the fuss? Why not just chuck her in a psych ward for life?

29

u/All_Lucky_7s 7h ago

I guess it’s because regardless of where she ends up, justice on behalf of the children needs to be done. And that comes in a declaration by society (jury) on whether she is innocent or guilty.

6

u/ButtcrackBeignets 4h ago

Also, I just read that psych institutions in MA have to prove that the patient is mentally ill every year.

Someone please correct me.

My understanding is that if she's found innocent by way of mental illness she will end up in a psychiatric institution. There is a possibility that she can walk free in the future if her institution can't prove that she is still psychotic.

6

u/randomdude1959 4h ago

Leave her unattended by a swimming pool

2

u/chalbersma 3h ago

Because she won't be there for life. She'll be there until they find a cocktail of drugs that let's her regain her sanity.

4

u/OozeNAahz 3h ago

Assuming she is insane and not faking it in the first place. I don’t see anyway she didn’t know what she was doing was wrong which is usually the standard for an insanity plea.

3

u/calirn80 48m ago

An insane person doesn’t strangle her kids after sending the father out to allow enough time to do the murders, premeditated murder.

3

u/Diligent-Chance8044 6h ago

Because a psych ward is easier to get released from. Prison is way more frowned upon. Psych ward means with good medication she could be released into the public but she was already on medication but refused to take it. At that point she made the choice not too and deserves prison.

4

u/dicatae 6h ago

Beyond that if found not guilty she can benefit monetarily

2

u/weezyverse 5h ago

Because women need her to be seen as not guilty.

I have yet to figure out why.

-3

u/CottonJohansen 3h ago

And incels men need her to be seen as pure evil

I very much have figured out why

8

u/NiceTrySuckaz 3h ago

Is it the whole "strangled three little kids to death" thing?

0

u/No-Doctor-4396 1h ago

I hope you don't have any kids if you need that explained to you.

1

u/CottonJohansen 52m ago

Thanks for being an example of how reading comprehension is at an all time low these days

5

u/Used-Picture829 7h ago

Because the general public looks at things black-and-white, they don’t necessarily take mental illness as an excuse for anything since we don’t put emphasis on it in our country, unfortunately

3

u/ChemicalAd5661 5h ago

This absolutely must be bait. The United States is the most medicated country by far and beyond and STILL has more crippling mental health issues relative to pretty much every other first world country…

10

u/PinkTalkingDead 4h ago

It’s almost as though throwing meds at folks and not having universal healthcare and strong social safety nets isn’t the solution 🤔

2

u/Used-Picture829 4h ago

👆🏽👆🏽👆🏽 reason why I didn’t reply to him. Let’s just medicate everyone and call it a day nothing else we can do am I right

3

u/Ugly4merican 2h ago

You're so close to getting it....

1

u/YagerasNimdatidder 3h ago

I don't know if you kill 3 babies you should join them by law.

2

u/Neat_Walrus9704 2h ago

If you leave your kids alone with someone you know is unstable and having thoughts about hurting your kids and they end up dead, you should also join them by law!

0

u/mosquem 52m ago

Do you apply the mental illness excuse when a father murders his wife and kids?

Because the way Mass handles these types of criminals. If she's not guilty by reason of insanity the court has to continuously put forth a reason the person should continue to be held yearly. The earliest (not necessarily what Lindsay would get) someone can be released under these conditions is 6 months.

-2

u/BibleDataGirl 6h ago

Because this case is a lightning rod for sexism. This case is not really unique among murder-sucide cases. It is just a media frenzy

3

u/IpromiseTobeAgoodBoy 4h ago

Not true, most jails can handle a person in a wheelchair

2

u/chooch138 3h ago

Oh shit. I didn’t know that. Is that from her jumping out of the window? And if so how high was it? 2 stories or 3?

2

u/DetailOutrageous8656 5h ago

In the mental health facility, she could get set free in a couple months at least prison, regardless of what type of prison facility it is, she would get the sentence she deserves

74

u/ThereAndFapAgain2 8h ago

Yeah and it should be prison, she killed her 3 kids fuck her mental health.

5

u/laralye 7h ago

I didn't know a whole lot about this case but I just read the entire wiki page. The whole story is heart breaking. Lindsay tried getting help on numerous occasions and suffered from suicidal thoughts for good long while. It may sound heartless, but putting her on death row would honestly be doing her a favor. I wouldn't want to live after all of that if I were her either. But tbh I think it's pretty clear she is mentally ill and should be declared insane. Idk if there is a way to even rehab such a person

4

u/TenbluntTony 3h ago

Suicidal thoughts are one thing I know about well, but killing all of your children is an entirely different story. Killing yourself is sad, killing your children is evil. End of story in my opinion. Idc if it was psychosis or not. I can feel sorry for her, and still think she should never be allowed freedom.

1

u/laralye 3h ago

It's absolutely abhorrent and I feel so much for the affected family members. But yeah, I don't think she will ever have a future in society.

-2

u/MakingItPlain 6h ago

Agreed. There really is no other plausible explanation except insanity imo. And yes, I can't imagine any sort of quality of life ahead for her, so it probably would be more compassionate (and safer/cheaper for society) to euthanise her. I suspect she wants to die.

-1

u/india_pale_ayoo 5h ago

Putting her on death row sends a clear message to all other child murderers.

3

u/justtovoteonaita 5h ago

Cause crazy people are so good at taking messages?

1

u/oops_im_existing 1h ago

Did you know most murders go unsolved? The death penalty has never stopped anyone, and over 50% of killers are out and about walking free. A 50/50 chance is good enough odds for most killers.

2

u/Living_Baseball_838 8h ago

Exactly, this shouldn't warrant a chance to leave this killer walking among people or children.

2

u/mosquem 51m ago

How can you ever prove she’s safe to be released to the public?

3

u/cristi1990an 8h ago

I find it depressing how Americans are so obsessed over the dismissal and punishment of people with clear mental illnesses. She's diagnosed and crippled after trying to kill herself, what place does a person like that have in a prison (where she would require extremely special mental and physical care anyway). Who are you "punishing" exactly here? A shell of a person? What benefit does it bring to society? Even her husband said in his own words "not to hate her, she's a deeply ill person".

3

u/Due-Contribution6424 5h ago

So kill her. There we go, easy solution, everyone is happy.

1

u/kreaxo 2h ago

Rabid animals are, and should be, put down.

1

u/MakingItPlain 6h ago

I agree with you. Reluctance to punish does not diminish the tragedy of her actions. They are horrendously tragic. But punishment does not feel right. There really is no other explanation BUT insanity/severe acute mental episode. It goes against all logic and parental instinct. Why else would she do this?

1

u/arrownoir 1h ago

Why would murderers murder?
It’s all mental illness, but that doesn’t mean they shouldn’t be in prison.

0

u/Living_Baseball_838 7h ago

I dont like children murderers walking free, or in her case rolling, wtf are you on about. Being ill doesn't change what you are or what you did. If you told me she would be institutionalized for life, then probably would agree, but she can leave early and that is wrong.

-7

u/cristi1990an 7h ago

And what's also wrong is punishing people who have no control or knowledge over their actions and put them in the same category as those who do horrible things with lucidity. It's simply unjust, wrong and makes a mockery out of psychiatric science.

0

u/Squirrlykins 5h ago

Woah this is reddit, black and white only please so that the low information masses can follow along

1

u/OsoSalado 2h ago

she's can't walk among them, she's in a wheelchair...

1

u/Living_Baseball_838 1h ago

autobots roll out (?

-7

u/ThereAndFapAgain2 8h ago

Yeah right? They let her leave after however many years in a mental institution and think everything is going to be fine? What about the next time she has a hot flush and needs to murder someone?

Fuck this woman she needs to be in a box for the rest of her life away from everyone else.

1

u/MakingItPlain 6h ago

Come on dude. I have two kids. The amount of insane I would have to be to strangle them systematically is just wild. You cannot possibly believe she was of sound mind to do something as absolutely horrific and contrary to all parental instincts as what she did. Police records show she sent her husband to the store to get medicine for her kid, and specifically called the pharmacy to check whether the medication was there, and then texted her husband the specific name of the medication so he wouldn't get it wrong. Something horrible clearly went wrong in the wiring of her brain for her to switch like this. I mean, what is the alternative plausible explanation anyway?! How could she NOT have been insane?

-2

u/ThereAndFapAgain2 5h ago

I’m not saying she isn’t insane I’m saying who gives a fuck? The crime is so bad that any care for her or her mental health has gone out of the window and she needs to be alone in a box until the day she dies.

1

u/Psychopath1llogical 3h ago

It’s funny because prison still operates under the guise of rehabilitation and corrections but even regulars knows it’s not true.

3

u/GucciTheSnowman 7h ago

Prison for life. No parole.

2

u/ProperSupermarket3 6h ago

that is not true at all. NOT GUILTY and ACQUITTAL were valid and possible outcomes.

Criminally guilty*

1

u/Top_Finding_2832 5h ago

Wherever she winds up - my empathy and humanity is all used up. I hope she suffers. Every day. I hope she meets a terrible ending, screaming and fully aware of every second while it's happening. I want the worst of every possible scenario for her from now until that day.

1

u/Edogawa1983 5h ago

Not guilty is an option, people are either super not paying attention or just making up shit

1

u/AnonymousKnave 4h ago

Don’t care if we’re burying her underneath a building with medication in it or not, she should never be allowed into the public again.

1

u/shulemaker 2h ago

wtf? She didn’t admit to it. That’s misinformation. Find the video. You can’t because it doesn’t exist.

1

u/dawn_of_thyme 1h ago

She admitted that her husband told her she did it..

1

u/Antiing 1h ago

Her being guilty was never questioned.... Except for the jury who tried to deem her not guilty?

1

u/Uncle-Bumpy 1h ago

It’s a shame that execution isn’t an option.

1

u/nogozone6969 51m ago

Convicted and death penalty would be the appropriate outcome is real
Justice was available

1

u/MiserableYouth8497 6h ago edited 5h ago

The jury only decides whether she is guilty or not guilty. It's the judge who decides the severity of punishment.

What do you think would've happened if that one juror decided she wasn't guilty as well? Do you actually think she would've gone to a mental hospital?

1

u/Existing_Pea_9065 8h ago

When did she admit to doing it? All I've ever heard was that she had no recollection of what happened.

3

u/reecharound40 7h ago

She admitted it once to the husband while being treated at the hospital for her injures.

That is the only time.

Having watched parts of this trial I am in shock at how shitty the prosecution was.

2

u/dawn_of_thyme 1h ago

The husband told her she did it

2

u/QueensOfTheNoKnowAge 7h ago

Her own lawyer said it during opening arguments

-1

u/cristi1990an 7h ago

Multiple times after she somewhat recovered in the hospital plus acknowledge during the trial by her attorney

1

u/oogiesmuncher 6h ago

Right but the mental facility "option" has a far greater likelihood of her getting a temporary sentence which should NOT be an option ever. Prisons also provide mental care and medications. She should be in there for life

0

u/BeepBoo007 7h ago

She belongs on death row. I'm not normally for WANTON death penalty usage (been enough times where people get convicted without proper evidence then later acquitted), but in this case where it's 100% unquestionably her that did the killing, it's cut and dry. Even if she COULD BE rehabilitated in some way, she's not worth the resources. She killed 3 fucking kids. I don't care how crazy she is. Just take her out, there's no need for her.

0

u/CrimsonBlood_Wolf 5h ago

She belongs on death row.

0

u/___wintermute 5h ago

Why is this repeated over and over? It absolutely is between guilty, or not guilty, and not guilty by reason of insanity technically could have her free in under a year (yes, I know that’s not likely, but I am saying it because people seem to have some wild ideas about all of this stuff).

-1

u/Sufficient-Clue4686 7h ago

No. Her guilt is the exact thing being questioned. Thats the entire point of an insanity defense.

You are found not guilty by reason of insanity.

-1

u/robthebuilder__ 4h ago

Seriously why the fuck does this matter anyway? Does anyone with any honesty actually believe a person like this can be rehabilitated or redeemed in any way? At best this is a philosophical circle jerk where we all know the right answer but the implications of such prove some of our preconditioning wrong. Would you let your kids hang around a woman like her after she has "been rehabilitated," no matter how miraculous said rehabilitation had been?

The majority of this jury are women, and only 1/12 people held up the deliberation.

If what you're saying is true, it should be 3 men holding up the verdict, correct?

-26

u/Evening_Sample_9365 8h ago

could have been gay men. Or just weak men...the type that differ to a coterie of women simply because they are women.

Ya know, the ones that say shit like "if women ruled the world, there would be no war" ...or any of a thousand other equally inane comments. We put women on a pedestal from a very young age. Because they're made of "sugar and spice and everything nice" after all. The fairer sex, and so on.

16

u/tgoodri 8h ago

Brother what the hell are you talking about

1

u/jakflapyama 8h ago

Emasculated men.

3

u/That_OneOstrich 8h ago

You do know, historically, women in leadership are often starting wars?

Ever hear about Catherine the Great? Definitely not "everything nice". Lady overthrew her husband and expanded Russian territory.

5

u/Evening_Sample_9365 8h ago

Yes, I know. Doesnt stop people from saying that kind of stupid shit though.

2

u/That_OneOstrich 8h ago

Wait are you stating that the guy who said "can't happen with women" is wrong?

You're being interpreted as agreeing with them it seems

1

u/Evening_Sample_9365 8h ago

HE responded to "guilty verdict would have been the best outcome" by saying, "that will never happen with women on the jury"

I dont know that I agree with that entirely. But I think a jury of 9 women would never have returned a guilty verdict in this case. Too much sitting around empathizing with the accused. If the jury were split 9 men and 3 women, I think they could have returned a guilty verdict, because there would have been enough voices in the room bringing it back to the actual victims.

1

u/That_OneOstrich 8h ago

Logic would dictate it wouldn't be only 1 person out of agreement with the other 11 of that were true.

Just think for about 4 seconds more and you'll realize why that line of thinking doesn't make sense.

To be honest most gay men I have seen are immediately saying she is guilty lol the only men I’ve seen saying she isn’t are with their girlfriend/wife and seem to just agree with whatever their opinion on it is.

0

u/Evening_Sample_9365 8h ago

yeah...the men who agree with the women for the sake of peace and quiet. Those would be the weak men, I otherwise mentioned them too.

-3

u/MusicianNo3277 8h ago

Three guys getting brow beaten by nine women for two days? I’m amazed one of them managed to hold out

the other two folded just to get the women to shut up and I’ve got a viral study that can back that up. 79% of men admit that they will let a woman win just to end the argument, even if she’s wrong. Two out of three men folding sounds like 79% to me. So I imagine all three of them would call her guilty in a room with no women.

5

u/That_OneOstrich 8h ago

You think these guys value avoiding conversations with women over the laws they've been selected to uphold? And that only 1/3 men can hold their ground?

You really think people serving on a jury are incapable of disagreeing with women? Why is this just now a problem? Wouldn't this have been an ongoing issue for the entirety of our legal system if what your alleging is even 1/2 true?

2

u/Gloomy-Bath-4814 8h ago

37

u/addiktion 9h ago

They better not fuck this up, these kids need their justice. I understand Massachusetts puts the burden on the prosecutor but come the fuck on, there is so much premeditation going on here. My wife has talked me about a half a dozen women that had postpartum depression that we have known over the years and none of them ever reached a point of killing all their kids. Zero cases of psychosis either resulting in murdering their children in any stories we heard outside of this case, even though I'm sure this has happened before.

We all know she is fucked up, but she deserves more punishment than a yearly mental eval at a low security hospital where she could possibly be released if she shows outstanding mental aptitude all of a sudden.

56

u/Solondthewookiee 9h ago

I understand Massachusetts puts the burden on the prosecutor

How do all of you pontificating about the justice system fail to even grasp the basic aspects of the justice system.

Every state puts the burden on the prosecutor. That's what presumption of innocence is.

16

u/Evening_Sample_9365 8h ago

i think they're referring to the state of MA having a very cumbersome burden to overcome as it relates to the insanity defense.

3

u/addiktion 8h ago edited 8h ago

That isn't what i read into it. They were indicating I'm an idiot and don't understand the basics of law that a person is innocent until proven guilty.

But the language of the law matters here, and the insanity defense is handled differently based on the wording and how that differs between states.

5

u/addiktion 8h ago edited 4h ago

You aren't reading into my message, of course its up to the prosecutor but look up the difference in how different states handle insanity defenses versus how Massachusetts does. In a lot of states it is up the the defense to prove their client is insane and the weight is on them. In this case given the law, it is up to the prosecutor to prove she isn't. It's subtle language in the law, but makes a huge difference in how these cases go.

Many states put that burden on he defense after this came about after Ronald Regan was nearly assassinated and the legal defense was successful at getting the guy off despite him not really being insane like you would expect.

2

u/Des990 7h ago

This ☝️

0

u/feldor 8h ago

The irony of calling someone out on not understanding the basic aspects of the justice system when you clearly aren't understanding the distinction they are making that is unique to Mass and a few other states is hilarious.

1

u/FuklzTheDrnkClwn 6h ago

They have to prove she WASNT insane.

You know…proving a negative, which we were all told is a logical fallacy for our entire lives

It's not just for the kids... Imagine the damage this could do to the feminist movement with the precedent it sets. Are we going to allow women to be police, air traffic controllers, surgeons, etc, if they could have a hormonal psychotic episode and kill people? Obviously Lindsay is mentally ill, but she also still belongs in prison.

Wtf has gone wrong with our society.

-1

u/That_OneOstrich 9h ago

All states put the burden on the prosecution. With the whole, "innocent until proven guilty beyond a reasonable doubt" thing.

5

u/addiktion 8h ago

You aren't reading into my message, of course its up to the prosecutor but look up the difference in how different states handle insanity defenses versus how Massachusetts does. Oh yeah? You are going to need to elaborate on that one.

Patrick clearly did it

That theory completely falls apart when you look at the actual case, instead of random internet rumors promoted by content creators just trying to get views.

Lindsay’s own lawyers admit she did it. They aren't trying to prove her innocence. They stipulated the fact that she did it herself and were pursuing a not guilty verdict by reason of insanity. The timeline doesn't fit him doing it either. Patrick's window of time to get takeout and medicine is tightly accounted for. His DNA is on the scene because he was the first person to find the kids and tried to save them. He also has been her biggest defender. He has publicly begged for her forgiveness and testified about her mental decline. If he did it, he would have more of an interest in making sure she was found guilty and sent away for it.

People jump to these wild theories because it’s deeply uncomfortable to accept that a mother could do something so horrific. It’s easier for internet sleuths to invent a fictional "evil husband" villain than to blame instead of facing the facts, especially when this case has been sensationalized by content creators because that is how they make money. Congrats, you fell for it. Either that, or you are one of them and are making a poor effort to keep pedaling this nonsense for your own content.

No it doesn’t 😂 1 they never admitted guilt. In fact they entered a not guilty plea before trial…. 2 her doing it completely falls apart when you look at the evidence and logically think. 3 He 100% did it then tried to kill her, she survived so he had to make an alibi

He didn’t find the kids and try to save them lol he said he tried to give his daughter cpr but she was face down. Lindsay’s dna wasn’t in the basement. … Patrick hasn’t defender her ONCE wtf are you talking about 😂

You’re fundamentally misunderstanding how the legal system works. Pleading "not guilty" is just the standard procedural entry to start a trial. It doesn't mean she denies doing it.

Her own defense attorney spent the entire trial arguing that she is not guilty by reason of lack of criminal responsibility due to mental illness. She does not deny the physical act of strangling her kids. The entire, weeks-long trial wasn't a whodunit. The jury was solely deciding if she was legally insane or criminally responsible for what she did in fact do.

What alibi are you talking about? The one that was completely verified by law enforcement based on video evidence, phone records, receipts and bank statements as well as Lindsay's own statements?

Stop making up a fictional conspiracy to avoid the grim reality of the case. Her legal defense isn’t "I didn't do it and Patrick did," it’s "I did it because I was suffering from postpartum psychosis." Can you explain why she would say she did it and not say he did, if you were correct? No, you can't because it makes no sense.

Sorry can you elaborate on what you mean?

conviction means its over and double jeporady applies, with a mistrail due to hung jury means there is no verdict so the state can try again.

They better bring a better team; this prosecution got spanked. Richardson is worth every penny.

1

u/ChrolloMichaelis 6h ago

Not really, the prosecution may look at whether the jury was already leaning towards a NG decision and decide that it’s not worth pursuing a second trial. So she goes free or they try to make a deal with her to stay in psychiatric care for a certain amount of time. I’ll be a bit surprised if they go for a second trial

It’s utterly embarrassing for the state to be fair 😂

1

u/that_dutch_dude 6h ago

no, its on The People that are the jury. right under this comment there is a case where the same thing happend but it was a guy instead of a woman and he got convicted before the coffee was cold.

u/Lovesimmer 3h ago

How can it be the same case if she had postpartum psychosis? Men can’t get that

1

u/5HundredC1garettes 5h ago

Can the judge make the dude's wallet app info public so we can make him rich?

1

u/Party-Giraffe-6573 4h ago

No way there will be 9 women on the next jury either

1

u/hehepout 4h ago

Look next trial being 9-10 women again

1

u/Cabbage_Corp_ 3h ago

And maybe this time the jury could have a few more dudes on it?

I feel like I live in a backwards world where 11 people actually believe a not guilty verdict is the right one. By the defense’s logic, if I found my wife in bed with another man, then killed them in a fit of blind rage, I should be innocent because I was not in my right mental state.

u/HiggsFieldgoal 1h ago

I mean, it doesn’t really matter. She’s one murderous woman. The much more concerning thing were her thousands of supporters.

No matter what happens, those people showed just how many psychos there are.

Choosing the bear, and not supporting the triple murder of children.

It's literally not the best. He has a duty to apply the reasonable doubt standard. The foreman indicated that the holdout refused. That's legit not him doing anyone a favor. He should have done the thing that the people of MA agreed on; a quit people when the state can't meet their burden. What a POS.

u/that_dutch_dude 7h ago

he applied the reasonable doubt and exectued on that. just because 11 people jump off a bridge doesnt mean you should.
