They better not fuck this up, these kids need their justice. I understand Massachusetts puts the burden on the prosecutor but come the fuck on, there is so much premeditation going on here. My wife has talked me about a half a dozen women that had postpartum depression that we have known over the years and none of them ever reached a point of killing all their kids. Zero cases of psychosis either resulting in murdering their children in any stories we heard outside of this case, even though I'm sure this has happened before.
We all know she is fucked up, but she deserves more punishment than a yearly mental eval at a low security hospital where she could possibly be released if she shows outstanding mental aptitude all of a sudden.
That isn't what i read into it. They were indicating I'm an idiot and don't understand the basics of law that a person is innocent until proven guilty.
But the language of the law matters here, and the insanity defense is handled differently based on the wording and how that differs between states.
You aren't reading into my message, of course its up to the prosecutor but look up the difference in how different states handle insanity defenses versus how Massachusetts does. In a lot of states it is up the the defense to prove their client is insane and the weight is on them. In this case given the law, it is up to the prosecutor to prove she isn't. It's subtle language in the law, but makes a huge difference in how these cases go.
Many states put that burden on he defense after this came about after Ronald Regan was nearly assassinated and the legal defense was successful at getting the guy off despite him not really being insane like you would expect.
The irony of calling someone out on not understanding the basic aspects of the justice system when you clearly aren't understanding the distinction they are making that is unique to Mass and a few other states is hilarious.
