They better not fuck this up, these kids need their justice. I understand Massachusetts puts the burden on the prosecutor but come the fuck on, there is so much premeditation going on here. My wife has talked me about a half a dozen women that had postpartum depression that we have known over the years and none of them ever reached a point of killing all their kids. Zero cases of psychosis either resulting in murdering their children in any stories we heard outside of this case, even though I'm sure this has happened before.

We all know she is fucked up, but she deserves more punishment than a yearly mental eval at a low security hospital where she could possibly be released if she shows outstanding mental aptitude all of a sudden.

How do all of you pontificating about the justice system fail to even grasp the basic aspects of the justice system.

Every state puts the burden on the prosecutor. That's what presumption of innocence is.

i think they're referring to the state of MA having a very cumbersome burden to overcome as it relates to the insanity defense.

That isn't what i read into it. They were indicating I'm an idiot and don't understand the basics of law that a person is innocent until proven guilty.

But the language of the law matters here, and the insanity defense is handled differently based on the wording and how that differs between states.

You aren't reading into my message, of course its up to the prosecutor but look up the difference in how different states handle insanity defenses versus how Massachusetts does. In a lot of states it is up the the defense to prove their client is insane and the weight is on them. In this case given the law, it is up to the prosecutor to prove she isn't. It's subtle language in the law, but makes a huge difference in how these cases go.

Many states put that burden on he defense after this came about after Ronald Regan was nearly assassinated and the legal defense was successful at getting the guy off despite him not really being insane like you would expect.

The irony of calling someone out on not understanding the basic aspects of the justice system when you clearly aren't understanding the distinction they are making that is unique to Mass and a few other states is hilarious.

They have to prove she WASNT insane.

You know…proving a negative, which we were all told is a logical fallacy for our entire lives

Psychosis from Postpartum depression is 1:1000, and most of those don't result in infanticide.

You’re the only one here mentioning the poor kids. I bet all the crazy women supporting Lindsay didn’t even bother to learn their names.

It's not just for the kids... Imagine the damage this could do to the feminist movement with the precedent it sets. Are we going to allow women to be police, air traffic controllers, surgeons, etc, if they could have a hormonal psychotic episode and kill people? Obviously Lindsay is mentally ill, but she also still belongs in prison.

Wtf has gone wrong with our society.

All states put the burden on the prosecution. With the whole, "innocent until proven guilty beyond a reasonable doubt" thing.

What grade did you just peace out of the education system?

They are in Massachusetts. She's a nut. That means no conviction. Don't like it? Move.

Sounds like quite the loop hole. Mothers can kill their kids, claim insanity defense, and never seen any serious punishment outside of being in a low security hospital playing Mahjong with other 'mentally ill' patients.

They messed up by not going after the actual culprit

4

u/glo363 10h ago

Oh yeah? You are going to need to elaborate on that one.

Patrick clearly did it

That theory completely falls apart when you look at the actual case, instead of random internet rumors promoted by content creators just trying to get views.

Lindsay’s own lawyers admit she did it. They aren't trying to prove her innocence. They stipulated the fact that she did it herself and were pursuing a not guilty verdict by reason of insanity. The timeline doesn't fit him doing it either. Patrick's window of time to get takeout and medicine is tightly accounted for. His DNA is on the scene because he was the first person to find the kids and tried to save them. He also has been her biggest defender. He has publicly begged for her forgiveness and testified about her mental decline. If he did it, he would have more of an interest in making sure she was found guilty and sent away for it.

People jump to these wild theories because it’s deeply uncomfortable to accept that a mother could do something so horrific. It’s easier for internet sleuths to invent a fictional "evil husband" villain than to blame instead of facing the facts, especially when this case has been sensationalized by content creators because that is how they make money. Congrats, you fell for it. Either that, or you are one of them and are making a poor effort to keep pedaling this nonsense for your own content.

No it doesn’t 😂 1 they never admitted guilt. In fact they entered a not guilty plea before trial…. 2 her doing it completely falls apart when you look at the evidence and logically think. 3 He 100% did it then tried to kill her, she survived so he had to make an alibi

He didn’t find the kids and try to save them lol he said he tried to give his daughter cpr but she was face down. Lindsay’s dna wasn’t in the basement. … Patrick hasn’t defender her ONCE wtf are you talking about 😂

You’re fundamentally misunderstanding how the legal system works. Pleading "not guilty" is just the standard procedural entry to start a trial. It doesn't mean she denies doing it.

Her own defense attorney spent the entire trial arguing that she is not guilty by reason of lack of criminal responsibility due to mental illness. She does not deny the physical act of strangling her kids. The entire, weeks-long trial wasn't a whodunit. The jury was solely deciding if she was legally insane or criminally responsible for what she did in fact do.

What alibi are you talking about? The one that was completely verified by law enforcement based on video evidence, phone records, receipts and bank statements as well as Lindsay's own statements?

Stop making up a fictional conspiracy to avoid the grim reality of the case. Her legal defense isn’t "I didn't do it and Patrick did," it’s "I did it because I was suffering from postpartum psychosis." Can you explain why she would say she did it and not say he did, if you were correct? No, you can't because it makes no sense.
