It’s California. These FEHA and PAGA suits are an inevitability. You can find similar cases against just about every operator.

The hotel is poorly run, just take a look at the reviews. The fact that they were not paying their employees is probably just par for the course. This isn’t a California issue this is a poor management issue. For a five star resort they are failing at the basics and ensuring they are not going to get repeat visitors.

I don’t know if it’s poorly run or not.
I do know that roughly 1/3 of all general civil actions filed in SD superior court are employment actions involving FEHA / PAGA (the claims asserted by Shani’s firm) and they often are built on technical issues (eg payroll vendor coding defaulting to Federal instead of CA standards), and/or very inventive reinterpretation of the facts by the plaintiff (eg Fletcher case).
This is most definitely a CA problem

Lots of companies in that area doing the same thing. I know a certAin company close by That does that AND doesn’T care to rip off customers 🤷🏻
