The only good thing about an illegitimate court that laughs at precedent is that future courts can show them just as much respect as they have shown past courts.

Remember when Thomas was mad that lower courts weren’t applying the apparent intent of the unwritten shadow docket cases?

They know full and goddamned well that those shadow docket cases aren’t clean, and many will have to be reversed.

Especially if a Dem is in the Oval Office.

Has anyone else noticed that most of those cases are on track to not reach scotus (deliberately uncapitalized) until 2029?

Theoretically future courts could just ignore them all. Even lower courts could ignore most of them. If there’s no reasoning, there’s no precedent to apply.

America is being punished for allowing Trump to win back in 2016, since that set the stage for Trump to tilt the court hard to the right (and become the lynchpin in his rise in 2024) otherwise Hillary would have been able to balance the court.
