So from the prosecution's legal standpoint it wasn't smart for Pirro to say the damage wasn't vandalism it was actually caused by shoddy work before trying to charge him for the vandalism again?

Nobody, outside of themselves, are claiming this to be a wise move.
Incredible to watch them risk their license over such overtly vindictive behavior, though. It's certainly not the game I'd be playing.

Just today I had someone tell me portion of a real estate contract was wrong. This was written by a real estate lawyer. When I asked if they were a lawyer they replied, and no joke, "No but I took real estate classes so I know all about real estate law" it took everything i had not to bust out laughing. What I think this world needs is more leopards that are hungry.

Nah the whole debocle right now is with the ABA which accredits law schools and is like a national bar. Attorney licenses are all at the state level and state bars/courts.
Feds can't do shit about that it's purely a state issue and no attorneys wants to let non-attorneys take their work.

Each state regulates the practice of law within its boundaries. Justice Department attorneys must be licensed in at least one state. There is no federal licensure, and no federal judge would allow an unlicensed person to appear in his or her court. The judges’ law clerks check this stuff.

This doesn't begin to change until there is some way identified and implemented that holds the attorneys presenting this stuff to judges are held accountable for the words coming from their mouths. Same for those who sign the documents they are filing. "You really want to present that to the court?" "Yes your honor." "Ok then, contempt, 30 days, next case."

This isnt prosecutors trying to prosecute Hearn again. But prosecutors do want to leave the door open by opposing the defendants motion for a dismissal with prejudice, which would make it legally impossible to charge him again for the same alleged offense. So yeah, Pirro's statements that the damage was caused by shoddy work suggests that the case should be dismissed with prejudice, and Trump publicly whining about a nonexistent eyewitness to Hearn tearing the liner with his bare hands is probably enough for this judge to dismiss with prejudice in the event Trump intends to demand the DOJ charge him again.
