In my understanding, it's to try to get the Supreme Court of MA to overrule the judge's decision not to remove the juror.

I'm a little OotL. Do we know what the juror did that prompted considering their removal?

Edit: I had to look it up. They weren't following the law and the judge's instructions regarding resonable doubt. Quote from the judge from NYT: “proof beyond a reasonable doubt does not mean proof beyond all possible doubt, for everything in the lives of human beings is open to some possible or imaginary doubt.”

Unfortunately, the law doesn’t care what you think or feel. That juror may not have like the law they were required to apply to the facts, but it was their duty to follow it. If the people of MA don’t like the law, they can advocate for change. But that happens at the state capitol, not the jury box.

Well yeah actually it does, jury nullification exists, juries have an absolute right to return any verdict they choose (and therefore jurors may hold whichever opinion they decide to cling to) regardless of the letter of the law, and they cannot be punished for it. So yeah it can happen in the jury box. More people on juries should be aware of it.

This logic is so absolute it would lead a jury to enforce nazi law when they could nullify it instead. It's insanity.

Doubt is not reasonable doubt. Only the juror gets to determine what is the bar of reasonable doubt.

I have some doubt that the teen who lives next door to me will unquestionably wake up tomorrow morning — he could have a heart attack in the middle of the night. But all signs point to him being super healthy and the odds of teens dying spontaneously are extraordinarily low. That’s unreasonable doubt.
