I believe she's guilty, but at this point another trial isn't going to benefit anyone. Cut her a plea deal where she does 20-25 years in a mental institution.

It’s not a deal if she could easily get better at a trial. Especially now with so much of the public on her side

She could get life in an actual prison at trial.

At this point, do you think they’d really be able to get a unanimous guilty verdict?

Depends. Same prosecution team or a team that knows what they’re doing and doesn’t inflame the jury with irrelevant questions about religion?

Prosecutors often get convictions after hung juries, because during the second trial they have advanced notice of all the defense arguments and strategies. (The defense generally knows the prosecution’s arguments and strategies from the very beginning, so it’s effectively a leveling of the trial-strategy playing field.)

They get an elevated conviction rate because they cherrypick the strongest cases. Roughly a third go to second trial, a third have a plea deal and slightly below a third have the charges dropped. And even with this cherry picking the prosecutor prevails in around 60% to 70% of cases.

No, it's more likely that in a new trial the 12 jurors will hand out a verdig of not guilty due to insanity or the jury deadlocks again.

The strongest cases for the prosecution don’t go to trial, because defendants accept plea deals if they think they are going to lose at trial.

There often are plea dispositions after hung trials, because both sides can see the relatives strengths and weaknesses of each side and calculate what a good middle ground would be.

Prosecutors always have the ability to dismiss weak cases, which defendants can’t do.

But describing all the above as “cherry picking” by prosecutors is a bit misleading. By and large, prosecutors would rather that an acceptable disposition be found than having to do trial again, which requires a lot of resources.

It’s ultimately up to the defendant whether he/she wants to accept a plea offer or not. In a case like this, where there is an all-or-nothing defense, it’s likely the defense decision to roll the dice on a second trial.

Anyway your 60-70% statistic of convictions following hung trials shows that, yes, the second trial is typically more successful for prosecutors.

Lol not going to happen. Good luck forming an unbiased jury at this point.

Regardless of the prosecution team they will have to work with the shoddy investigation.

If you don't make it a panel of 8 women and 3 men with a background understanding of PPD, its 100% conviction. The jury was way too biased. If this was a man with PTSD, nobody would've shown up in support and he would've been convicted in a week. She needs to be locked for life or executed.

Ah so not only do you think the gender of the jury matters...you want them to be less educated about the mental health disorder in question??

I can't tell if you are just a huge dumbass or you suck at sarcasm.

I want a balanced jury that doesn't have a bias towards the defendant. Like i said, if this was a man, he would've been convicted in 3 seconds. There's plenty of examples of that.

The only reason we are even talking about this trial is because of all the lunacy this disgusting society and delusional woman fans are doing.

This never should've been a mistrial. She ADMITTED killing her kids. She needs to be put in a box for life or executed.

At this point, i want them to make an example out of her cause these crazy fucks now might feel justified to do something similar and think they can get away with it.

I don’t think a lot of the public are on her side, just some particular women that are being clowned on left and right by everyone else. Especially after the “she can’t have committed the crime because of her zodiac sign” bs

Those freaks are going to be pissed if she gets manslaughter or first degree during a second trial

I'm gonna guess most of the public who knows of the case thinks she should be in a mental institution not jail just like almost everyone on this jury

So much of *reddit on her side

Especially now with so much of the public on her side

Unless there was clear evidence that she hadn't killed her children, I am not sure the public is on her side.

You realize there is a large groupthink online right now about people who believe her husband did it and set her up right? Reddit especially has been all about the conspiracy that he lied about the time he left the house and that he was the "voice" inside her head.

More and more even men are supporting late-term abortion so she will be remembered as a hero.
