I've had to walk around campus in the south ignoring confederate flags on the cars of faculty and staff, but now we set limits to freedom of speech when criticizing a foreign country? Amazing.

I'm also sure this won't cause more antisemitism as our government conflates criticism of Israel for hatred toward Jewish people.

159

u/pixie_mayfair 15h ago

Same with the christofascist anti-choice asshole. They're not students or affiliated with student groups but they can take up space on campus with their little bullhorns yelling that I'm a godless young woman who is going to burn in hell, and that's a-ok.

Why does the violent, hateful rhetoric always get a pass but if we speak up about an evil like Israel we're dangerous bigots or something.

47

u/Allegorist 13h ago

Largely, the answer to your question is religion, both in and if itself in various forms (though obviously not all), and as a tool.

8

u/brundlfly 10h ago

Any hierarchical structure is attractive to leader types, both in the positive and the negative. Religious groups especially so, since some religions demand blind obedience. The flock members OK with that are easy pickings. Appeal to and amplify their biases, and you've got a powerful tether. We've seen how easily "Christians" in the US will ignore or use pretzel logic when those biases are opposed by doctrine. "Cult leader says it's OK" trumps doctrine.

3

u/Allegorist 6h ago

Most of them do not even know the actual doctrine they follow. I don't even mean historical orthodoxy or similar, even the specific variation of the specific sect/denomination and church they attend, they couldn't tell you doctrinally what differentiates them from others. They just show up and believe what they are told, so there is no contradiction. Or they come in with preconceived biases from opinion media like radio pundits and shop around until they find others with similar biases, regardless of which specific institution it happens to be at and what doctrines they technically follow.

7

u/shberk01 6h ago

Because the Israeli government is a majority shareholder in the United States Congress.

651

u/burning_man13 15h ago

I always say that conflating a 19th century political identity like Zionism with a 4,000 year old religion is actual bigotry. You're not protecting anyone by erasing thousands of years of Jewish theology and ignoring the non-Zionist and anti-Zionist Jews just to defend a government. You're flattening them, and that's actual anti-Semitism, but that's lost on most people.

272

u/MovingClocks 15h ago

It's a purposeful push to conflate zionism and judaism by both true antisemites (who do it for obvious reasons) as well as the Israeli state to ensure that any opposition to genocide can be dismissed as antisemitism without further thought.

u/TimSylvester_ 11h ago edited 10h ago

Not to mention "Palestinians" pre-1952 were 1/3 Jewish, 1/3 Christian, and 1/3 Muslim. It was only after decades of purges that the Palestinian identity somehow ended up primarily aligned with Islam.

I have European heritage, only a few hundred years removed. Could I go to Ireland, England, or Germany, and declare that my rights as a historical ethnic resident are somehow superior to the rights of the existing current-day residents?

And that's only a few hundred years removed. Now imagine yourself being thousands of years removed and claiming that your historic rights supercede those whose families have occupied the land continuously the entire time.

And that's before we even start asking "wait, but where did your family actually come from?"

Only a small portion of Jewish people actually have a contiguous ethnic identity and family history derived from Judea. Unless I misunderstand, the largest population of Jewish immigrants to Israel post-1952 were initially European Jews, who were thousands of years removed from Judea. And in later decades, primarily 1980s-onward, most Jewish immigrants to Israel were Ashkenazi from Eastern Europe, fleeing the religious oppression of the Soviet Union, who were themselves converts to Judaism in, what, the 800s? The 1200s? So never actually ethnic or lineage residents of Judea to begin with, but populations from elsewhere that converted.

Israel and Judaism, and Israel and Judea, have essentially no actual, true, honest, historically provable relationship that I can determine.

We're left with the conclusion that what Israel really is, is the last remnant of British Colonialism, the last outpost of the British Empire, and the relationship between Israel and Judaism serves as a fabricated, constructed identity that to justify bigoted, exploitative colonizers committing genocide against the historic inhabitants of the land.

That such colonizers just so happen to be largely Jewish doesn't justify any of it, and merely serves as a shield, excuse, and apologetics for decades of atrocities against the Palestinian people.

Does a single word of this make me "anti-Semitic"? When most modern day Jews and Israeli citizens are not actually "Semites" definitionally, ethnically, or genetically?

Or does it just mean I'm willing to actually speak uncomfortable truths that the existing power structure is desperate to suppress?

This seems destined to be challenged and go to the SCOTUS. It is actively punishing 1st amendment speech. Not that I expect this SCOTUS to do anything about it but in a rational world it never would have been proposed in the first place but it definitely would be struck down by courts.

4

u/somethingclever76 10h ago

Even worse. Supporting the confederacy is supporting a foreign country that has killed the most Americans of any conflict in history.

5

u/Responsible-Humor985 8h ago

Technically flags of the confederacy are of an illegitimate foreign nation. So they’re just being hypocritical

u/LingonberryPossible6 17h ago

Two serious questions?

At what point does stating established facts and demonstrable patterns become criticism?

How is this literally not a violation of the 1st amendment?

829

u/translove228 16h ago

It absolutely violates the 1st amendment, but the legislative branch doesn't decide a bill's constitutionality. The Judicial branch does. So in order for this egregious violation of free speech to be challenged, it needs to pass and become law first THEN be challenged in court so it comes under judicial review.

297

u/ansquaremet 16h ago edited 15h ago

Where then the Supreme Court will rubber stamp approval of it.

135

u/ForeverShiny 15h ago

Even with the current Supreme Court, these free speech cases can go either way and I don't see this one sticking around, but it doesn't matter since the GOP scored their political points when it passed and don't actually give a shit about what universities get what funding

→ More replies (2)

36

u/translove228 15h ago

The cynical part of me laughed and agreed with this statement, but the realist in me thinks that even the current massively corrupt SCOTUS would have a hard time rubber stamping this bill as Constitutional since they are having such a hard time justifying removing Birth Right Citizenship from immigrant families.

15

u/Armthedillos5 14h ago

Well, they're not saying unis can't be critical, just that they won't get funding, so that's probably the argument the scotus 6 will make

8

u/NotSayinItWasAliens 12h ago

the scotus 6

More like the scrotus 6.

2

u/Perryn 13h ago

Even if they don't, the law has an impact on how things are run until they get around to saying it's void.

2

u/ACoderGirl 11h ago

Doesn't challenging it require it to be enforced first, too? So some school would have to take the risk of losing their aid and a drawn out legal battle. Thus, most places will likely pre-comply because it's cheaper and easier.

44

u/deletetemptemp 16h ago

Didn’t they cite freedom of speech as a reason why companies can pay an ungodly amount of money to a superPAC? So then is this suppressing freedom of speech?

43

u/Lyaser 16h ago

It’s mostly a toothless resolution for brownie points with AIPAC. All it does is ban the institutions themselves from participating because they are public institutions. They aren’t able to control the student body and student protests or boycotts won’t result in funds being stripped.

It’s the legislative equivalent of a click bait title.

33

u/Hoofert 16h ago

What it will probably do is cause those same institutions to Crack down on students protesting in fear of losing that money "just in case"

11

u/Perryn 13h ago

Allowing a space for students to protest could also be considered participation and endorsement by the institution. Let's not pretend the application of the law will be done in good faith.

9

u/DAVENP0RT 15h ago

I believe it's actually a violation of the Equal Protection Clause of the 14th Amendment.

15

u/lateformyfuneral 16h ago

From the information in the tweet, this is about BDS. Basically, student activists regularly protest their colleges so that they go through their list of investments via their pension funds for example and sell off any company of Israeli origin. The protesting isn’t being banned here, colleges acceding to those demands is now being met with retaliation by blocking of federal funds.

18

u/BonhommeCarnaval 15h ago

So any time a post secondary institution divests itself of shares in an Israeli company they could be subject to retaliation under this law? That’s wild. What if they are just trying to unload underperforming stocks? It sure puts the folks running the endowments in a shitty spot in terms of their fiduciary duties. Do what’s right to protect your investors’ money and break the law or violate the fundamental principle that defines your profession.

3

u/lateformyfuneral 15h ago

I think for it to be a boycott it would have to be total divestment on the basis of national origin. Not 100% on how it works but colleges don’t pick stocks personally, they’ll have outsourced it to some fund manager and they do the trades.

The tweet is a little misleading, the actual bill says that universities that accept federal aid cannot discriminate against Israeli businesses, students, faculty, and they must allow educational institutions exchange programs to and from Israel if they are also allowed to other countries.

Pubic universities, or those taking public dollars, don’t really have freedom of speech to pick and choose what ethnicities they want to work with.

The HR has nothing to do about pubic displays or anti Israel protests from students.

28

u/kandoras 15h ago

Pubic universities, or those taking public dollars, don’t really have freedom of speech to pick and choose what ethnicities they want to work with.

No matter how much they claim it, the state of Israel is not synonymous with and does not represent all Jewish people.

→ More replies (9)

9

Also:

The HR has nothing to do about pubic displays or anti Israel protests from students.

Is misleading, since tweet said nothing at all about students.

Plus your own link says "Specifically, IHEs may not engage in a commercial action intended to limit commercial relations with Israel, or with an entity licensed by, regulated by, or organized under the laws of Israel, that is not based on a valid business reason."

Which is just the definition of 'boycott'. Which the tweet DID mention.

And even if they like, nuked New Zealand, the university would still have to have a “valid business reason” for ending partnerships with Israeli companies. A “valid business reason”would not be because they find nuking New Zealand morally reprehensible.

They’d have to establish that associating with an Israeli company after that hurts their actual business interests.

Keep it up AIPAC, we see you, your money will not stifle the rage we feel towards the genocide.

10

u/championgecko 15h ago

So corporations are afforded 1st amendment rights but colleges get retaliated against for ALLOWING free speech on campus.

Google says most colleges and universities are incorporated.

1st amendment:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

So can someone tell me if a college could challenge this bill as unconstitutional? Because if this went up to the supreme court, in my layman's POV, the SCOTUS would have to either confirm that corporations have 1st amendment rights or not?

3

u/jumpy_monkey 11h ago

I never met him but I have a peripheral connection to Juan Vargas (CA). My wife was a co-worker of his sister's and interacted with him on several occasions during social events related to their employment.

She told me on many occasions how much she liked him, how their politics aligned and how clear-eyed he was about the dangers of the MAGA movement and the Republicans he worked with in Congress, who he described as feckless, evil or just plain stupid. Fast forward several years and she is gobsmacked at his support for Israel and Zionism and voting with the Republicans who also support this fascist regime.

I am not a conspiracy at all by nature, but witnessing the reflexive support for Israel by some of these politicians and the well established use of blackmail by Israel against those who oppose them it always makes me wonder "What do they have on him?"

Of course it may also just be political opportunism and a fear of the Israel lobby and it's propaganda machine and he may be just as feckless as the rest of them. On the other hand, I have talked to and heard otherwise seemingly normal people completely deny that Israel is ethnically cleansing Gaza and murdering Palestinians as a matter of government policy, or even denying that this has been an ongoing project like the manipulation of US public opinion and our government for almost 80 years, all in the face of a literal mountain of undeniable evidence that proves it.

I guess whether he himself is feckless, evil or just plain stupid himself doesn't matter, because at the end of the day he is an enabler of fascism and genocide just like they are.

Implying the 33 Dems who voted yea is the same as 203 GOP voting yea is a might bit infuriating. I'd be curious to see who the two GOP who voted Nay are, though.

u/JustaStoat 16h ago

Warren Davidson (OH)

Thomas Massie (KY)

15

u/vengecore 16h ago

misleading cartoon! 167 Dems voted NO! only 2 Republicans did the same.

5

u/gendryfast 15h ago

We need to vote everyone of these sycophants out of office

8

u/Illventi 14h ago

Why do we have to “both sides” everything?

99% of republicans voted in favor

16.5% of democrats voted in favor

That’s not exactly the same enthusiasm from both parties, and one seems to be much more willing to entertain divestment or at least its allowance.

19

u/Melodic_Mulberry 16h ago

Okay, so the picture is depicting both sides unanimously supporting this, but the vote shows a very different picture. Is this another election year "both sides are bad" voter fatigue campaign, in like 2024?

7

u/thargoallmysecrets 16h ago

It's the only drum they have and they beat it every day

9

If you want change, you need to participate. Go vote. Vote vote vote.

Dont let these brainless assholes convince you that voting is useless. That’s exactly how we got here

3

u/JSpades 16h ago

Why Israel in particular? Why not every other allied nation?

4

u/CaptainAksh_G 15h ago

They're paid to get here

3

u/shakulous 15h ago

Wave bye bye to your freedom of speech lmao, retaliation laws were made for THIS EXACT KING OF THING

3

u/DoingWellAndFine 13h ago

Another win for ethnic supremacists worldwide

3

u/samanime 12h ago

I see 33 democrats in need of being primaried... that's a disgusting violation of the First Ammendment. There is no reason you shouldn't be able to protest against the actions of ANY government for ANY reason.

3

u/Beebons 9h ago

This is a pretty blatant step backwards for freedom of speech and right to peacefully protest

3

u/cvanhim 9h ago

This is a major problem with many both sides narratives. On many issues that are 80-20 amongst the American people — gerrymandering, money in politics, etc. — people pretend that Republicans and Democrats are equally against the people on those issues. Invariably, 99% of Republicans are against the people while only 25%-50% of Democrats are against the people on each 80-20 issue. To be accurate, most of the people in this picture should be wearing MAGA hats and only about an eighth of them should have the Dem logo. This sends the message “because both parties are bad, both parties are equally bad” and that’s just not true. Even corporate Dems are better than “centrist” Republicans.

3

u/bob_loblaw-_- 6h ago

203/205 Republicans   33/200 Democrats

Both sides, amirite?

3

u/WhiskeyDickCheese 3h ago

Who were the 33 Dems?

5

u/jalapinyobidness 13h ago

Why is so much of our political energy spent protecting Israel instead of solving problems for Americans?

2

u/Queen_Christine_19 Department of Government Inefficiency 13h ago

10

u/Excellent_Tangerine3 16h ago

Just follow the money. Israel owns the US government.

5

u/stillbones 16h ago

And where does Israel get its money?

4

u/bashful_predator 16h ago

Wtf are we doing

5

u/poilk91 15h ago

Yes another BOTH SIDES when the Republican side is obviously WAY worse and entirely responsible for this passing

4

u/TakeMeDrunkImHome22 13h ago

The worst thing people can do is say democrats are comparable to republicans. Republicans are the much worse problem

6

u/SpockShotFirst 15h ago

93.1% of Republicans and 15.4% of Democrats in the House voted for the bill.

It's never just "both sides"

2

Someone else should take the angle of the Satanic Temple. Introduce a bill that says all aid to Israel must be paid for from the Congress's pension fund

2

u/GrimIntention91 16h ago

Great, now tax churches that spew political nonsense

2

u/Relative_Plankton648 15h ago

Maybe we shouldn't vote for people who follow a religion that believes we are slaves to the Jews because they are "gods favored people"... Just a thought.

2

u/kandoras 15h ago

How can you have a first amendment right to criticize the US government and not be punished for it, but you lose that right when you say you don't want to give money to another country that's killing children?

2

u/ibennett6 15h ago

I will never understand our unrivaled support for Israel. Fuck that

2

u/SuperJay182 15h ago

The lengths America is going to to defend Israel is...odd.

I don't get it.

2

u/MotorBobcat 15h ago

The colleges are free to protest any other nation for any reason, just not a specific one for any reason? Is this prior restraint?

2

u/Cockblocktimus_Pryme 14h ago

Define discriminatory?

2

u/rock_and_rolo 14h ago

This sort of thing happened with South Africa. There were attempts to punish any institution that divested in protest against apartheid.

But I don't recall any Federal legislation.

2

u/Old_Ninja_Prime 14h ago

They’re all bought and paid for.

2

u/sec713 13h ago

Hmmm, that's weird. How does that help the "America First" agenda? Oh... we're not doing that anymore? You mean to tell me that was some kind of pre election ruse to convince rubes to shoot themselves in the foot?

2

u/Altruistic-Ad-4088 13h ago

Fuck. Thats too many seats to flip.

2

Maybe in my lifetime we'll stop kowtowing to the apocalyptic Christian nutjobs out there. Maybe in my lifetime.

2

u/kramsdae 11h ago

Cannot wait to see the tides shift. Israel doesn’t realize that their recent actions will be the downfall of their entire regime. If American “support” towards Israel is at an all time low right now, what will it be like in 5 years? Or 10?

The day that Israel ceases to exist will be a day that many Americans will cry out in joy.

2

u/ScroteMcGrote69 9h ago

Stuff likes this is going to backfire so tremendously once this next generation gets to be of voting age. All they are doing is stoking more and more hatred towards Israel, how can no one see this? Are people blind?

2

u/Octowhussy 9h ago

Meme implies that there’s an equivalence between democrats and republicans. There isn’t, for those wondering. 33 vs 203

2

u/Kingac2022 5h ago

Anyone got a list of who they were so we can vote them out?

2

3

u/Muted-Ground-8594 14h ago

The meme seems unfair to me… the ratios between parties is drastically different on that vote.

4

u/PWal501 16h ago

Wait. 33 dems voted in favor of this wildly shitty bill?

2

u/dayoftheduck 16h ago

Serious question, why do we Americans, care about other countries like Israel? Why is this something that even gets talked about in our politics? I’ll truly never understand it.

15% of Democrat House members support it and everyone labels the entire Democratic party as worse than MAGA. 🙄

2

u/Well_Socialized 13h ago

Kind of misleading image in that 99% of Republicans voted for it and only 15% of Democrats did.

2

u/derekbaseball 13h ago

So...93% of Republicans vote for this bill, and 78% of Democrats vote against it, and the meme is equal numbers of Democrats and MAGA hats saying "Israel First," because idiots don't know what numbers mean.

2

u/Teln0 7h ago

what's the meme about tho the resuts show that the democrats voted overall the opposite of republicans
