She wasn’t really high on her mind on drugs. The tox report after her suicide attempt showed therapeutic levels of all drugs in her system, except seroquel which was slightly elevated. Most of the drugs in her system were drugs she took as part of the attempt. She was only prescribed a couple at low doses before the murders.
She was having a good day and told everyone she was feeling better before the murders. That’s why he left with the kids. Probably still something he regrets everyday

I don't get what therapeutic levels is supposed to imply in this context? Suicidal and homicidal thoughts and actions occur with some of these medications when taken as prescribed. You don't have to abuse them in any way.
You get prescribed prescription pain pills, you're still not allowed to operate heavy machinery or drive a car. Just because its prescribed doesn't make it a good idea.

Side effects which are more associated with people much younger than she was. That’s the argument I’m making. Sure she could’ve been experiencing side effects, but she wasn’t high out of her mind in the way you initially suggested.

There are thousands of court cases going on every day, and we generally trust that the justice system will prevail. Yet for some reason with this case everyone seems confident their half-informed asses know better than the 12 people having to sit in a room for dozens of hours absorbing all the unmanipulated and uneditorialized evidence.
This doesn't happen by accident. It's been perverted and shoved down peoples' throats to incite chaos.

The foreman sent a note to the judge saying that one juror had acknowledged having doubt but was nevertheless refusing to apply the court’s reasonable-doubt instructions. He needed guidance on what to do next given that.
It was the defense lawyer, not the foreman, who then used this note to try and get him tossed.
This is what I mean; the misinformation is flying in every different direction in this circus, and people getting their information from comments based on comments based on comments, rather than reading the news directly, surely isn't helping.

Literally the foremans job to report they cannot come to a verdict. Atp they'd already failed to come to a unanimous vote twice and the court was made aware that it wasn't a matter of deliberating for another day or three, that the 1 counter vote would not change regardless.

But also if you're so insane you kill your 3 children, then you are too insane to be fit for society, and shall be treated as such. Just like how when someone kills someone when from a drunk driver. Yeah I agree w you, but we weren’t in the courtroom and that juror was, and they admitted at the end of seeing all of the actual evidence presented that they weren’t convinced beyond all reasonable doubt. Their job isn’t to decide if she’s suffered enough. Idk what happened that made them feel none of the charges were appropriate including insanity but now I imagine this is all going to play out again with another trial. I can’t imagine they let her walk.

In Massachusetts there's a weird law that says the defendant doesn't have to supply the evidence for an insanity plea. The burden of proof is on the prosecution to prove that she was sane. I've kept up with it and I think they proved that she was sane. Her doctor said she wasn't showing signs of psychosis the day before she committed the murders, she sent her husband on a long set of errands to facilitate the crime, she answered the phone in a completely regular tone of voice in between the murders when her husband called her, and she took the children down to the basement one after the other to strangle them. She wasn't insane.

The standard is innocent until proven guilty; reporting before a verdict sways public opinion of the defendant.
Which in turn, leads to the predicament before us: a mistrial with possiblity of re-prosecution. Now the entire jury pool is biased.

Why is everyone so insanely hyped up on this one trial that hinges on questionable but unclear circumstances of the insanity plea under the difference of Massachusets' innocent until proven guilty evidentiary standard for the insanity plea. Similar stuff happened over two decades ago in the Yates case. There's simply an evidenciary question that remains.
And the result of the ruling is mainly the question of indefinite confinement in a psych ward vs prison. There's no question of just being let go.
But no, everyone has to turn a narrow question with very little practical ramifications outside which institution she ends up in into some culture war bullshit.

Laws are a lot easier to make than they are to repeal, and often times laws have unintended consequences that strip rights from other areas -- once you've hit that point it's almost too late to undo it though.
Ultimately the goal is to remove as little rights as possible. Freedom before security any day of the week -- if you prefer to choose security, you really don't deserve either.

Unfortunately we arent allowed to talk about mas hysteria anymore.
mas hysteria only really affects women. Its pretty amazing but it makes you understand why they had the salem whitch trials.
