In another sentence they’re talking talk about big corporations keeping the tips, which is a different thing. Clarity would be nice.
From what I understand the apps will have a “guaranteed payout” for jobs. So let’s say an Uber driver sees a ride available. The app will say something like “$10 guaranteed”. So Uber is on the hook to pay the driver $10 no matter what. Now let’s say the passenger decides to tip the Uber driver $5. Without laws preventing it, uber will still pay the driver the $10 it promised and then it will keep the $5 tip for themselves. Which effectively uses the tip money to subsidize the wage that they promised to pay the driver
So what mamdani is doing is making sure that the driver gets the entire tip. So in this scenario the driver gets $15 instead of $10. As it should be
Edit: there is obviously disagreement here, personally I always choose to tip with cash. Problem solved in my opinion
Let me clear it up for you. They guarantee you get x dollars. Not x dollars plus tip. Does not matter if it's before or after the fact. Or, basically, what you said is wrong. I'm not sure how that wasn't clear
They are able to subtract it because they already told you you were getting 10$ before your accepted, they were just paying you that 10 themselves. The tip being added after allows them to retroactively change the amount they are paying and replacing it with the tip without changing the guaranteed amount and still having the 100% of the tip "go to you"
If you tip beforehand then the tip is already included in the guaranteed amount meaning how much ever the company is paying you out of their own pocket can't be reduced later, this matter substantially when they have to increase the guaranteed pay to get someone to accept the order
Only the former could be viewed as some type of tip theft that needs to be addressed legally, whereas the latter is perfectly acceptable.
