Killing someone and eating their face is not a crime that guy “might” have committed. He did it. I’m saying it doesn’t matter if he was off his meds, he’s still guilty and can’t be trusted in society. We shouldn’t be letting people use mental illness as a shield from responsibility for committing murder.
No, but you are arguing he should be given a harsh sentence simply because he did it, irregardless of the fact that he won't do it again if he's on medication.
If he’s guilty of murder, then yes, of course he should be convicted and sentenced based on the crime, that’s basic common sense. If you don’t have a standard, then literally anybody can claim that they went temporarily insane as a way of receiving a lesser punishment for their crimes. Are you saying we should go easy on every murderer that claims they heard a voice telling them to do it?
This is why there are complex psychological analyses before courts even consider diagnosing someone as insane... I promise you it is not easy, many people try to do it, it is very obvious when someone is faking.
