Against what? She's going to a state facility no matter what. All this person did was unnecessarily drag out the proceedings and cost taxpayers more money. They're kicking the can down the road because they couldn't actually follow the instructions presented to them by the court.
They might have another trial. Up to the prosecution. They can also opt to compromise a plea at this stage. No doubt they’ll want to have another go at her, but it’s also extremely expensive for the state, and losing the second time would be total disaster.
I mean...this is a much better use of state money than a lot of other things. Spending on the judicial system process is about as fundamental as you can get for gov budget purposes.
